Basic Law, Article 2, para. 1

Every person shall have the right to free development of his personality insofar as he does not violate the rights of others or offend against the constitutional order or the moral law.

 

Two basic rights are derived from this article: general freedom of action and general freedom of the person. General freedom of the person includes, among other things, the basic right of informational self-determination, i.e. the freedom to decide on the disclosure and use of one's own personal data. 

The photograph depicts a normal day at the Ebertplatz square in Cologne. The Higher Regional Court of North Rhine-Westphalia has authorised the police to monitor the square via CCTV due to the prevalence of street crime. However, when the square is used for demonstrations, the CCTV system must be shut off to protect the protesters’ freedom of assembly (Art. 8 of the Basic Law).
